Pets & Service Animal Policy

High Noon Beach Resort is a commercial transient lodging facility. As such, we follow the rule of law regarding Service Animals set forth by the Department Of Justice, (DOJ). Service Animal Defined by Title ll and Title lll of the ADA A service animal means any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability.

Emotional support animals, comfort animals, and therapy dogs are not service animals under Title II and Title III of the ADA.

It is illegal in numerous states to falsely claim an animal that is only a pet is a service animal. ln Florida, falsely claiming a pet as a service animal is a second-degree misdemeanor under $ 413.08(9), Fla. Stat. (2023), and a conviction can result in a jail sentence of up to 60 days plus a $500 fine. Service animals generally, a public accommodation shall modify policies, practices, or procedures to permit the use of a service animal by an individual with a disability.

Exceptions. A public accommodation may ask an individual with a disability to remove a service animal from the premises if:
(i) The animal is out of control and the animal’s handler does not take effective action to control it;
or
(ii) The animal is not housebroken.

Signs and traits to identify that an animal might not be a service animal:

  • The animal is not leashed.
  • The animal is being pushed in a cart or carried
  • The animal is barking or whining.
  • The animal is pulling on their leash.
  • The animal wants to sniff everything.
  • The animal looks uneasy or nervous.
  • The animal steals food from tables or eats scraps on the ground.
  • The animal is not properly housebroken and has “accidents” inside.

We advocate for the rights of people with legitimate service animals, but when false claims are made, as to service animals, we will protect our rights by:

  • Reporting our suspicions of false claims to the local police
  • File a report with the ADA
  • Ask the offending party to leave
  • Florida Statute 413.08 (9)

(9) A person who knowingly and willfully misrepresents herself or himself, through conduct or verbal or written
notice, as using a service animal and being qualified to use a service animal or as a trainer of a service animal
commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083 and must
perform 30 hours of community service for an organization that serves individuals with disabilities, or for
another entity or organization at the discretion of the court, to be completed in not more than 6 months.

SECTION 775.083 (e) Fines.
